1. It is expressly pointed out to the fact that the management of the holiday village Freilingen acts only by order and for calculation of the holiday cottage owners as a mediator. The management provides the tenancy and the in each case agreed achievements between the holiday cottage owner and the tenant. The holiday cottages are all a private property. Equipment and state of the houses are incumbent upon the respective owner of the holiday cottage.
2. The tenancy encloses the whole holiday cottage with all what belongs to it.
3. The holiday cottage may be booked for the maximal number of persons according to the hire contract. If the tenant with more people than in the contract given appears, the manager of the holiday village can deny the admission to the not announced people. Should a number of persons arise due to some circumstances, it can be accepted only within the scope of the admission capacity with approval of the manager.
4. The tenant accepts with signing the hire contract the existing holiday village order.
5. The tenant is obliged to send a signed copy of the hire contract back to the management within one week after delivery, and to make deposits according to the given appointments. If the tenant does not fulfill his obligations, or not on time, the manager is entitled to dispose the holiday cottage for the other purposes.
6. The tenant can terminate the hire contract 30 days prior to its beginning at the latest. The deposit in this case is lost. In case of later cancellation the whole agreed rental sum is to be paid. If the holiday cottage can be otherwise rented for the same time to equal conditions, the tenant loses only the deposit (25%). If the tenant provides at the same time with his cancellation a new tenant who enters into the full rights and duties of the tenant, only one handling charge of 20 EUR is to be paid.
7. The lessor can cancel the hire contract without notice in cases of force majeure, such as thunderstorm, strike, war, etc. Damage claims of the tenant against the lessor are excluded.
8. The tenant has to treat the holiday cottage and the inventory available in it with care. The beds may not be used without bedclothes. This stays under the control of the manager of the holiday village.
9. The tenant is obliged to replace all the damages occurred during his lease. The tenant is obliged to proof that the above damages are not his fault neither of a person, accompanying him. He assumes the liability for fault-incapable children. Requirements on the damages to introduced property of the guests are to be regulated in the same way.
10. Domestic animals may be brought only with approval of the manager. The owner of the animal is responsible for the damages that may happen. For a stay with domestic animals a cleaning surcharge from currently 25-50 EUR per animal and week will be taken.
11. The manager is Mr.Oliver Reinking, holiday village, Tel.: 02697 / 76 25, fax: 02697 / 75 26. On your arrival, you are kindly asked to contact Mr.Reinking and to introduce yourself. You should have the hire contract with. A 100,- EUR deposit will be taken with the receipt of the keys and will be refunded by a proper handover of the holiday cottage and the keys at the end of your stay. Otherwise this amount can be retained and used for the removal of caused damages. If the costs are higher then the mentioned deposit, a surcharge is to be paid.
12. Indecent behaviour, non-compliance of the holiday village order or non-implementation of the orders of the manager which serve for the protection of the proper use of the holiday cottage and the general equipment can lead to the immediate terminating of the hire contract. Claims of the tenant, as well for the partial back-payment of the lease, will not be accepted in this case.
13. All additional costs are included in the all-inclusive rent price, such as, electricity, water, final cleaning.
14. Bed, table linen and towels are to be provided by the tenant.
15. The final cleaning of the holiday cottage is arranged by the management after the tenant has moved out. The tenant must leave the house well-swept. In particular washing of dishes and waste disposal is not included in the final cleaning. As well an additional cleaning during the stay is possible. An additional cleaning costs currently
30, - EUR per house.
16. The rent price encloses the occupancy of the house with maximum 4 people. For each next person a surcharge of 10 EUR currently per day is to be paid.
17. The hire contract comes into force after being signed by the tenant.
18. Place of performance and legal venue for both parts is Blankenheim/Eifel or according to the legal regulations.
